Penalties for Drunk Driving
In California, the penalties for a conviction of driving under the influence can include:
- 1st DUI: 4 days to 6 months’ jail, $1000 fine, 10 months’ license suspension
- 2nd DUI: 10 days to 1 year jail, $1,800 fine, and 2 years’ license suspension
- 3rd DUI: 120 days to 1 year jail, $1,800 fine, and 3 years’ license suspension
- 4th DUI: 16 months’ prison, $18,000 fine, and 4 years’ license suspension
What these penalties don’t list out is the impact that a DUI conviction can have on your job, relationships, and future career and housing opportunities, just to name a few of the consequences of living with a criminal record. We understand what is at stake for you, and we are ready with zealous advocacy that gets results.
Chemical DUI Tests & Implied Consent Law in CA
If you failed a blood or breath test, it is still possible to demonstrate that an error was committed in the results, either in how the test was administered, sealed, or tested, etc. Chemical DUI tests have been proven erroneous before. If you refused to even take a breath or blood test, however, you will lose your driver’s license for one to three years, even if you are acquitted of the DUI charges.
This is because of implied consent law: If you have a driver’s license, you have implied your consent to take any chemical DUI tests requested by an officer who pulls you over.
